Typically a Class B misdemeanor carries a possibility of a fine not to exceed $2,000.00, a Class A misdemeanor carries a possibility of a fine not to exceed $4,000.00, a state jail felony, third degree felony, and first degree felonies carry a possibility of a fine not to exceed $10,000.00 However new legislation was enacted and effective September 1, 2019, provides a “super fine” of $3,000.00 for a first conviction of operating a motor vehicle while intoxicated within a 36-month period; $4,500.00 for a second or subsequent conviction within a 36-month period; and $6,000.00 for a first or subsequent conviction if it is shown on the trial of the offense that an analysis of a specimen of the person’s blood, breath, or  urine showed an alcohol concentration level of 0.15 or more at the time the analysis was performed. Added by Acts 2019, 86th Leg., R.S., Ch. 1094 (H.B. 2048), Sec. 14, eff. September 1, 2019. A person who is found guilty of DWI will also face fees and costs of the court which could add up to thousands of dollars.
